Targeting what is commonly known as "birth tourism," U.S. Immigration and Customs Enforcement (ICE) has initiated specialized investigations into organized networks that facilitate travel for pregnant foreign nationals. According to a report by Reuters, the administration has ordered a zero-tolerance approach toward agencies that assist women in providing false information on visa applications to enter the U.S. specifically for childbirth.
The move marks a central pillar of President Trump’s intensified immigration agenda since returning to office. White House spokesperson Anna Kelly stated that these activities impose an unfair financial burden on American taxpayers and present a growing risk to national security. While giving birth in the United States is not inherently illegal, the Department of Homeland Security emphasized that utilizing visa fraud or concealing the primary intent of travel to secure citizenship constitutes a serious violation of federal law. Authorities are now focused on dismantling the commercial infrastructure that has turned birthright citizenship into a lucrative international business.
In a decisive move to end the practice permanently, President Trump has issued an executive order stating that children born on U.S. soil will not be granted citizenship unless at least one parent is a U.S. citizen or a legal permanent resident. This executive order is currently under review by the U.S. Supreme Court, as it challenges the traditional interpretation of the 14th Amendment. Supporters of the move argue that the amendment was never intended to grant citizenship to the children of temporary visitors, while critics maintain that the President lacks the constitutional authority to override birthright principles via executive fiat.
Research from 2016-2017 indicated that approximately 20,000 to 25,000 foreign women travel to the U.S. annually for the purpose of giving birth.
